Participants in Have Ya Herd, LLC events, agree to the following terms and conditions:

GENERAL INFORMATION
• Wear comfortable, washable clothing. Put  long hair up, and avoid long, dangly and sparkly jewelry. Athletic blend t-shirts are discouraged, as it makes it hard to keep a goat on your back! Cotton t-shirts/sweatshirts are best!
• You may bring a water bottle and hand towel. Personal items (purses or backpacks) can be left at home or in a locked car. Phones/cameras are encouraged, did it really happen if you didn’t get a selfie?! Have Ya Herd is not responsible for lost or stolen items.
• No one will be admitted into the goat yoga space without paid admission and signed waiver, not even to take pictures. *Unless under special circumstances, such as a reporter, with prior approval.
• Arrive a few minutes prior to the start of class to allow plenty of time to check-in and sign the waiver. Please don’t arrive earlier than that, and avoid coming in late as it disrupts the class and the calm the instructor is going to try to create for you and the goats.

• Due to the fact that goat yoga classes generally sell out, we cannot accept walk-ups at this time. All participants must pre-register.

NEW FOR 2020 COVID GUIDELINES

• Required temperature check.
• Masks are recommended but not required.
• Bring your own mat (ours will not be available).
• Social distancing in place as best as possible.
• No bathroom available.
• Minimum of 10 registrations per class or class is canceled.
• A minimum of 2 tickets must be purchased.

CANCELLATION POLICY
Have Ya Herd events may occasionally be canceled when there is insufficient attendance, or if a teacher has an emergency. If a Have Ya Herd event is canceled you will be notified by email and/or phone call as soon as possible prior to the event, and will receive a full refund or credit toward a future event.
If less than 10 people are registered by 5:00 P.M. the day before an event, you will be refunded in full and a notification of class cancellation will be sent via email and/or a phone call to registrants. Have Ya Herd is not responsible if registered participants appear for a canceled event after a failed attempt has been made to notify them.
If you cancel less than 4 business days before your scheduled event, NO REFUNDS OR RESCHEDULES will be provided.
If you cancel more than 4 business days before your scheduled event, a FULL REFUND OR A RESCHEDULE will be provided.
As a courtesy, if you are suddenly unable to attend an event, and are already past the 4 business days cancellation requirement, please contact Have Ya Herd so we may release your registration to individuals on our wait list.

SPECIAL EVENT CANCELLATION POLICIES
Special events require a 30% non-refundable deposit, and advance payment in full (100%) is required to complete special event bookings.  Cancellation of special events must be made 30 days in advance of scheduled event. If an event is canceled by the private event planner after the 30-day advance notice period has expired, a refund of 50% will be issued. Special event cancellations made 30 days or more in advance of the event date, will receive a 70% refund.
If we believe bad weather conditions will pose a safety concern for your event, we will contact you via email and/or phone call to reschedule. It is highly suggested that the special event coordinator has a secondary indoor location, should inclement weather happen the day of the event.
If you booked a private event that WE CANCEL due to poor weather conditions, we will do our very best to reschedule. If this is not possible, we will issue a full refund. There is no cancellation fee if Have Ya Herd cancels your party.
If cash payment for an improperly canceled event is past due, 30% interest will be charged every 30-day period past the specific event date. Event dates may not be transferred to another date after payment has been made unless approved prior to event date by Have Ya Herd, LLC.

WEATHER RELATED CANCELLATIONS
Have Ya Herd offers a sheltered area for participants to continue yoga practice during some inclement weather conditions. If you choose to cancel due to inclement weather, you will not be refunded due to location coverage from elements.
When weather and other physical conditions present a danger to participants, Have Ya Herd staff maintain the right to cancel the event. If threatening weather conditions force cancellation of the event, you will be given a full refund or credit toward a future event.
Have Ya Herd events may be canceled if any of the following weather conditions exist: Tornado Warning, Tornado Watch, Thunderstorm Warning, Thunderstorm Watch, “Heavy” Rain, Blizzard Warning, Blizzard Watch or other major weather condition.
In the event of a cancellation all participants will be notified via email and/or phone call. Have Ya Herd is not responsible if registered participants appear for a canceled event after a failed attempt has been made to notify them.

SPECIAL CONDITIONS AND INJURIES
Anyone with serious medical conditions or injuries should consult a doctor prior to participating in our fun fitness classes. Have Ya Herd classes offer a wonderfully therapeutic practice and we encourage you to listen to your body, taking the appropriate modifications. Your yoga practice should not cause pain. It is your responsibility to inform the instructor if you are pregnant or have any injuries prior to the start of class.

YOUNG STUDENT POLICY
Any student under 18 years of age must have a parent/guardian’s signature on the waiver.
Our classes are designed for students 13 years of age and older. Students under 18 years of age may attend classes when a parent or guardian is in attendance for the same class providing they want to attend the class and participate. To participate in Have Ya Herd, LLC events, you need to be 18 or older, or be age 13 or older and have your parent or guardian’s consent to the agreements listed below. WAIVER & RELEASE DOWNLOAD
** Minors may not roam the Have Ya Herd property unsupervised while the parent or guardian takes a class. The Have Ya Herd staff are not authorized to supervise children.**

LIABILITY RELEASE
This agreement releases all individuals related to Have Ya Herd, LLC from all liability relating to injuries that may occur during Have Ya Herd events.
I agree to hold Have Ya Herd, LLC and all those associated entirely free from any liability, including financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence.
I also acknowledge the risks involved in Have Ya Herd, LLC events. I swear that I am participating voluntarily, and that all risks have been made clear to me. Additionally, I do not have any conditions that will increase my likelihood of experiencing injuries while engaging in this activity. Participant understands that farm animals will be part of the goat yoga activity and accepts and assumes the risks associated with the use of farm animals while engaging in this activity. Participant hereby freely and expressly assumes all risks of property damage, injury and death associated with goat yoga and farm animals. In consideration for participation in goat yoga, participant hereby agrees to release, hold harmless and indemnify the yoga instructor, Kevin P. Lubich, Jessica L. Lubich and Have Ya Herd, LLC, a Wisconsin limited liability company, their members, heirs, successors, assigns, independent contractors, employees, agents and instructors from any and all claims by or on behalf of participant against any claim, injury or otherwise arising directly or indirectly out the participant’s participation in goat yoga.
I forfeit all right to bring a suit against Have Ya Herd, LLC and all those associated for any reason.
THE UNDERSIGNED HEREBY ACKNOWLEDGES THAT HE/SHE HAS READ THIS RELEASE, FULLY UNDERSTANDS ITS TERMS AND CONDITIONS, UNDERSTANDS THAT HE/SHE HAS GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS RELEASE AND HAS SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO THE UNDERSIGNED AND INTENDS HIS/HER SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ANY AND ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

APPEARANCE RELEASE
I hereby acknowledge that I am of legal age, and affirm that “Have Ya Herd, LLC” has the right and permission to use my name and to use, reproduce, edit, exhibit, project, display, copyright, publish images and/or moving pictures and/or videotaped images of me with or without my voice, or in which I may be included in whole or in part, photographed, taped, videotaped, and/or recorded to circulate the same in all forms and media for art and advertising.
I hereby waive any right that I may have to inspect and/or approve the finished product or products or the editorial, advertising that may be used in connection therewith and any right that I may have to control the use to which said product may be applied.
